A year ago, a U.S. military tribunal sentenced a Saudi man to 15 years in prison for his role in the 1996 Khobar Towers bombing, the worst terrorist attack on U.S. soil.

Since then, however, the man has spent nearly all his time in Guantanamo Bay, in Cuba.

That prison camp, just 90 miles from the coast of Florida, is where the Saudi and his cohorts are still being held, largely in secret, more than three years after the attack.

The Khobar Towers case—which to this day has not been adjudicated by any of the U.S. courts—is an important legal test for the Obama administration. It shows how the Guantanamo Bay regime is relevant to the criminal justice system as well as how the president can continue to keep suspected terrorists behind bars.

It is also an important test of how the administration is doing its job in prosecuting terrorism cases in civilian court.

One of the many unanswered questions in the Khobar case is whether the Saudi’s Guantanamo defense team will be able to secure a fair trial and full representation at the tribunal.

How can a prisoner held in a maximum security prison in Cuba be afforded the same degree of legal representation as a defendant in a federal courthouse in New York, Washington or San Francisco?

It is important to remember that the Khobar court is not a federal court. It is run by the military.

Its proceedings are closed to the public and are presided over by a three-judge panel known as the Combatant Status Review Tribunals, or CSRT.

Unlike federal courts, the tribunals are under no obligation to follow the law or even the constitution.

The only check on their power is the executive branch.

But here’s the catch: The Pentagon says it is not following its own procedures to run the Khobar court.

Specifically, they say it is not in full compliance with the law set out in the Military Commissions Act of 2006.

The Military Commissions Act allowed military tribunals to investigate charges of terrorism, but not to prosecute them.

Yet, in the years since the Khobar court was set up, it has done just that.
